Public offer for access to the CAPS service

Parties and subject matter

Individual entrepreneur M. N. Zinovyev (OGRNIP 326774600287471, INN 770602340640), hereinafter the "Provider", offers any legally capable individual or legal entity, hereinafter the "User", to enter into an agreement on the terms of this offer.

The subject matter is remote access to the CAPS service at capsclips.ru. The service automatically turns the User's long-form video into short vertical clips: it finds the fragments, reframes them, and adds subtitles and styling.

How the agreement is concluded

The agreement is concluded when the User creates an account on the site and confirms their email address. This constitutes full and unconditional acceptance of this offer under Articles 437 and 438 of the Civil Code of the Russian Federation.

A User who does not agree with these terms does not create an account and does not use the service.

Plans and coins

Access is provided by subscription. The current plans and their prices are published on the pricing page at capsclips.ru and form part of this offer.

The volume of service is measured in internal units called coins. Coins are credited when a subscription is paid for and are spent on processing: one coin per minute of source video and twenty coins per finished clip.

Coins are not money, electronic money or securities. They cannot be exchanged for cash or transferred to another User.

Prices are stated in Russian roubles. VAT is not charged under clause 2 of Article 346.11 of the Tax Code of the Russian Federation.

Payment and automatic renewal

Payment is made by bank card through the YooKassa payment service. The Provider neither stores nor processes card details — they remain with the payment service.

The subscription renews automatically: on the last day of the paid period, the price of the next period is charged to the linked card at the current plan rate.

No later than 24 hours before an automatic charge, the Provider sends the User a notice to the email address given at registration, stating the amount and the date of the upcoming charge.

The User may switch off automatic renewal at any time in their account. Doing so does not end the current paid period — access continues until it expires.

Trial period

Selected plans offer a 7-day trial period. Activating it requires linking a bank card; a minimal verification charge may be made at activation and then refunded.

When the trial ends, the subscription becomes paid and the price of the chosen plan is charged to the card, unless the User cancelled earlier.

The trial is granted once. The Provider may refuse a trial that has already been used by this User, this card or this device.

Rights in the material

The User uploads only material they hold the necessary rights to, and is solely responsible for this.

Rights in uploaded material and in the clips produced from it remain with the User. The Provider processes the material solely to deliver the service and does not use it otherwise without separate consent.

The Provider may refuse to process material that breaks the law or infringes third-party rights.

Liability and availability

The Provider makes reasonable efforts to keep the service running but does not guarantee uninterrupted operation: scheduled maintenance and outages beyond the Provider's control are possible.

The service operates automatically. The Provider does not guarantee any particular number of views, reach or other outcome from publishing the clips produced.

The Provider's liability under this agreement is limited to the amount paid by the User for the period in which the breach occurred.

Changes and contact

The Provider may change this offer and the plans by publishing a new revision on this page. Changes do not apply to a period already paid for.
